Terms of Use

These terms cover your use of the Posture Alert app. By downloading or using it, you agree to them. If you do not agree, do not use the app.

Licence

We grant you a personal, non-exclusive, non-transferable licence to use Posture Alert on Apple devices you own or control, as permitted by the App Store Terms of Service. You may not resell or redistribute the app, and you may not reverse engineer it except where that restriction is prohibited by law.

Posture Alert Pro

Some features require Posture Alert Pro, sold through Apple In-App Purchase as a monthly subscription, a yearly subscription, or a one-time lifetime purchase.

A subscription unlocks every Pro feature for the length of the period you choose, and renews for that same length until you cancel. A lifetime purchase unlocks them once, with nothing to renew. Current prices are shown in the app before you buy, in your local currency.

  • A subscription renews automatically unless you cancel at least 24 hours before the end of the current period.
  • Your Apple Account is charged at confirmation of purchase, and again for each renewal within 24 hours before the current period ends, at the price shown in the app at that time.
  • Manage or cancel a subscription under Settings, then your Apple Account, then Subscriptions. Deleting the app does not cancel a subscription.
  • Any unused part of a free trial is forfeited if you buy a subscription during that trial.
  • Refunds are handled by Apple under Apple’s policies, not by us.

Not medical advice

Posture Alert is a wellness aid. It is not a medical device, it does not diagnose, treat, or prevent any condition, and nothing it shows you is medical advice.

If you have ongoing neck, back, shoulder, or eye pain, see a qualified professional. Do not use the app in place of professional care.

Accuracy

Posture tracking depends on the motion sensors in your AirPods and on how they sit in your ears. Readings are estimates. They can drift, and they can be wrong. Use your own judgement about how you are sitting.

Availability

The app is provided as is. We do not promise that it will be uninterrupted or error free, or that it will stay compatible with every future version of iOS or every pair of AirPods.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the app. Nothing in these terms limits liability that cannot be limited by law.

Apple is not a party to this licence

This licence is between you and DEVELOPER_NAME only. It is not an agreement with Apple, and Apple is not responsible for Posture Alert or its content.

  • Apple has no obligation to provide any maintenance or support for Posture Alert. Send support requests to support@sitwell.app.
  • If Posture Alert fails to conform to any warranty that applies to it, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation of any kind.
  • We, not Apple, are responsible for any claim relating to Posture Alert, including product liability claims, any claim that it fails to meet a legal or regulatory requirement, and claims under consumer protection or privacy law.
  • We, not Apple, are responsible for investigating, defending, and settling any claim that Posture Alert infringes a third party intellectual property right.
  • You confirm that you are not located in a country subject to a US Government embargo or designated as a terrorist-supporting country, and that you are not listed on any US Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms, and Apple has the right to enforce them against you.
  • You must comply with any applicable third-party terms when you use Posture Alert.

Who publishes Posture Alert

Posture Alert is published by DEVELOPER_NAME, DEVELOPER_ADDRESS. Send questions, complaints, or claims to support@sitwell.app.

Governing law

These terms are governed by the laws of GOVERNING_LAW, without regard to its conflict of law rules. Nothing here removes any protection you have under the mandatory consumer law of the country you live in.

Changes to these terms

We may update these terms. The date at the top of this page changes when we do, and continuing to use the app after that means you accept the updated terms.
